Terms of Service

1. About ArmsbyDigital

ArmsbyDigital is a digital services business operated by Jack Armsby, United Kingdom. We provide website design and development, QR business card production, and access to the Nottinghamshire Contractor Partnership (NCP) network for tradespeople. By purchasing our services, you agree to these Terms of Service in full.

2. What We Provide

2.1 The Full Package

Your £799 setup fee covers:

  • A fully designed and built website, personalised for your trade and location
  • On-page SEO including meta titles, descriptions, and local schema markup
  • Mobile-first, responsive design
  • WhatsApp contact integration
  • QR portal business card design and production
  • Domain registration in your name (approximately £10–15/year, included in setup)
  • Membership of the Nottinghamshire Contractor Partnership (NCP) network

2.2 Monthly Retention (£79/month)

Your £79/month subscription covers:

  • Ongoing website hosting via Cloudflare Pages
  • Continued NCP network membership and profile management
  • Website updates and content changes on request
  • Technical maintenance and support

Your first monthly payment begins 30 days after your setup payment date.

3. Ownership of Assets

3.1 Your Domain

Your domain is registered in your name from the point of purchase. ArmsbyDigital does not own your domain at any time. You have full ownership. We manage the DNS settings on your behalf for as long as you are an active client. Upon cancellation, DNS management is returned to you with full instructions.

3.2 Your Website

Your website and all content within it belongs to you. ArmsbyDigital builds and manages it on your behalf. We do not claim ownership of your website, your copy, your photos, or your business information at any time.

Upon cancellation, you will receive all website files (HTML and content files) so you can host your site independently if you choose.

3.3 NCP Network Access

The Nottinghamshire Contractor Partnership (NCP) network is an ArmsbyDigital product. Access to the NCP network is available exclusively to active ArmsbyDigital clients. Upon cancellation, NCP network access and all associated network connections will be removed from your website. This is a feature of active membership and cannot be transferred or retained independently.

4. Payment Terms

All payments are processed securely by Stripe. By completing payment, you agree to Stripe's terms of service in addition to these terms.

  • Setup fee: £799, charged at point of purchase
  • Monthly subscription: £79/month, beginning 30 days after setup payment
  • All prices include VAT where applicable
  • Payments are non-refundable once the build process has commenced (defined as receipt of your completed intake form)

If a payment fails, we will notify you by email. You have 7 days to resolve the payment before your subscription is paused. Services will resume automatically once payment is resolved.

5. Account Freeze

5.1 What a Freeze Means

We understand that tradespeople have quiet periods. You may freeze your account for up to 3 months per calendar year. During a freeze:

  • Your monthly £79 payment is paused for the duration of the freeze
  • Your website remains live and accessible
  • Your NCP network card will display an orange indicator instead of green, indicating temporarily inactive status
  • You will not receive website update support during a freeze period

5.2 How to Request a Freeze

To freeze your account, you must notify us by email to jack@armsbydigital.co.uk at least 7 days before your next billing date. Freeze requests received less than 7 days before billing cannot be applied to that billing cycle.

5.3 Freeze Limits

Freeze periods are limited to a maximum of 3 months in any calendar year (January to December). Freeze months do not need to be consecutive. Your account will automatically reactivate at the end of your requested freeze period and normal billing will resume.

6. Cancellation Policy

6.1 How to Cancel

To cancel your subscription, you must send a written cancellation request by email to jack@armsbydigital.co.uk. Cancellations require 30 days written notice. Your subscription will remain active and billable during this 30-day notice period.

6.2 What Happens When You Cancel

Within 48 hours of your cancellation being confirmed:

  • NCP network access and all network connections will be removed from your website immediately
  • You will receive a complete handover package containing all your website files and domain DNS instructions
  • Full guidance will be provided on how to manage your domain and host your website independently

96 hours after your cancellation confirmation:

  • All ArmsbyDigital systems, records, and data relating to your account will be permanently deleted
  • This includes your database client record, any stored files on our systems, and your entry in our internal records
  • This deletion is permanent and irreversible

6.3 No Refunds on Notice Period

Payments made during the 30-day notice period are non-refundable. The notice period exists to allow proper handover and is considered active service time.

7. Your Responsibilities

To allow us to deliver your website to the highest standard, you agree to:

  • Provide accurate and truthful information in your intake form
  • Ensure you have the right to use any photos, logos, or content you submit to us
  • Respond to any queries from us within 5 working days to avoid build delays
  • Not use your website or NCP membership for any unlawful or harmful purpose
  • Notify us of any changes to your contact details, trade information, or services

8. Our Responsibilities

ArmsbyDigital commits to:

  • Delivering your completed website within 5–7 working days of receiving your completed intake form
  • Building your site to the agreed specification based on your intake form
  • Maintaining your website hosting with a minimum 99% uptime target
  • Responding to support requests within 1 working day
  • Treating your business information and personal data with confidentiality

9. Limitation of Liability

ArmsbyDigital is not liable for:

  • Loss of business, revenue, or profit resulting from website downtime
  • Any third-party service interruptions (including Stripe, Cloudflare, or domain registrars)
  • Content errors resulting from inaccurate information provided in your intake form
  • Any indirect or consequential losses

Our total liability to you in any circumstances is limited to the total amount paid by you to ArmsbyDigital in the 12 months preceding any claim.

10. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of our services after that date constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
